These Terms of Use ("Terms") govern your access to and use of the website, products, and services (collectively, the "Service") operated by Insofta Development ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

   You may use the Service only if you are at least 18 years old, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into a binding agreement.

You are responsible for all activities that occur under your account.    The Service may include downloadable software, icon collections, online mockup generation tools, user accounts, prepaid credits, and related digital features. We may modify, suspend, or discontinue any part of the Service at any time.

   Certain features may rely on third-party providers as described in our Privacy Policy.

4. Payments, Credits, and Taxes

   Some parts of the Service are paid. Payments, refunds, and credits are governed by our Refund Policy.

   Credits are non-transferable, non-refundable except where required by law, and have no cash value. You are responsible for applicable taxes. Prices may include or exclude VAT depending on your location.

5. Digital Product License

   You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to use purchased software or digital assets.

   You may not resell, redistribute, sublicense, or make assets available as standalone files or use them to create competing services.

6. User Content

   You retain ownership of uploaded content. You grant us a worldwide, non-exclusive, royalty-free license to process and display it for providing the Service.

   You represent that you have all necessary rights and that your content does not violate any laws or third-party rights.

7. Generated Output

   The Service allows you to generate mockups and other visual materials based on content you upload ("Generated Output").

   Subject to your compliance with these Terms, we grant you a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute the Generated Output for personal and commercial purposes.

   You may use the Generated Output in marketing materials, websites, social media, advertisements, and other commercial projects.

   However, you may not resell, sublicense, redistribute, or make available the Generated Output as standalone files, templates, or in any way that allows third parties to use or extract them as a competing product or service.

   You are solely responsible for the content you upload and for ensuring that you have all necessary rights to use such content and the resulting Generated Output, including compliance with intellectual property, trademark, and other applicable laws.

8. Prohibited Use

   You may not use the Service for unlawful purposes, to upload harmful or infringing content, interfere with the Service, or attempt unauthorized access or reverse engineering.

9. Fair Use and Abuse Prevention

   You agree to use the Service in a fair and reasonable manner consistent with its intended purpose.

   You may not use the Service to generate excessive or abusive levels of requests that may disrupt, degrade, or negatively impact the performance, availability, or integrity of the Service.

   You may not access or use the Service through automated means, including bots, scripts, scraping tools, or similar technologies, except where explicitly authorized by us.

   You may not attempt to bypass, exploit, or circumvent any usage limits, credit systems, security measures, or technical restrictions implemented by the Service.

   You may not use the Service to build, train, or improve any competing product or service, or to systematically extract or reproduce outputs at scale.

   We reserve the right to monitor usage patterns and to suspend, limit, or terminate access to the Service at our sole discretion if we determine that your use is excessive, abusive, or in violation of these Terms.

10. Intellectual Property

    All Service materials (excluding User Content) are owned by us or our licensors and are protected by law.

11. Privacy and Cookies

    Our data practices are described in our Privacy Policy. Our use of cookies is described in our Cookie Policy.

12. Service Availability

    We do not guarantee uninterrupted or error-free operation. We may modify or suspend the Service at any time.

13. Termination

    We may suspend or terminate access at any time. Your right to use the Service ends immediately upon termination.

14. Disclaimer

    The Service is provided "as is" without warranties of any kind.

15. Limitation of Liability

    To the maximum extent permitted by applicable law, we and our affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, business opportunities, goodwill, use, or data, arising out of or in connection with your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

    To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the total amount you paid to us for the Service during the 12 months preceding the event giving rise to the claim.

    Nothing in these Terms shall limit or exclude liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, fraud, or death or personal injury where required by law.

    You agree to indemnify us against claims arising from your use of the Service or your content.

    These Terms are governed by the laws of Russian Federation, and disputes will be resolved in its courts unless required otherwise by law.

    We may update these Terms at any time. Continued use of the Service constitutes acceptance.
